1. Who you are dealing with
This website is operated by ISHAARA FZE LLC, a free zone company licensed in Ajman, United Arab Emirates, with its registered office at Office BC-892442, 26th Floor, Amber Gem Tower, Sheikh Khalifa Street, Ajman, UAE. In these terms “we”, “us” and “our” mean ISHAARA FZE LLC; “you” means the person using the site or placing an order.
2. Accepting these terms
By browsing this site, creating an account, or placing an order, you agree to these terms. If you do not agree with them, please do not use the site. We may update these terms at any time; the version published here when you place your order is the version that governs it.
3. Eligibility
You must be at least 18 years old, or be using the site with the consent and under the supervision of a parent or guardian, and you must give accurate and complete information when you order.
4. Products, images and descriptions
We describe every piece as accurately as we can. Our jewellery and drapes are made and finished by hand in small batches, so weave, zari, plating tone and hand-finished detail vary slightly from piece to piece and from the photographs on screen. Screens also render colour differently. This variation is normal and is not a defect.
Listing a product on the site is an invitation to order, not an offer. We may correct errors, change a description, or withdraw a piece at any time before your order is accepted.
5. Orders
Your order is an offer to buy. A contract is formed only when we confirm that the order has been accepted and dispatched. We may decline or cancel an order — and will refund you in full — where the item is out of stock, where the price or description was listed in error, where payment cannot be verified, or where we reasonably suspect fraud or resale.
6. Prices and payment
Prices are shown in the currency displayed at checkout and include VAT where it applies under UAE law. Shipping is charged as shown at checkout. We accept the cards and payment methods listed at checkout, including cash on delivery where offered. You confirm that any card or account you use is yours and has sufficient funds.
Prices can change at any time, but a change never affects an order we have already accepted.
7. Delivery
We ship across the United Arab Emirates. Delivery timelines given on the site are estimates, not guarantees, and can be affected by the courier, customs, weather and public holidays. Risk in the goods passes to you on delivery to the address you gave us. Please make sure that address and contact number are correct — we are not responsible for parcels delayed or lost because of an incorrect address or an unreachable phone.
8. Returns and refunds
Refunds are governed by our Refund Policy, which forms part of these terms. In short: a refund is available only where the item arrived damaged and a continuous 360° unboxing video shows that damage. Such a claim must be filed within 7 days of delivery, and the full amount is then refunded. No other refunds, returns or exchanges are given.
9. Your account
You are responsible for keeping your account password confidential and for everything done under your account. Tell us immediately if you believe your account has been used without your permission. We may suspend or close an account that is being misused.
10. Acceptable use
You agree not to:
- Use the site for any unlawful purpose, or in breach of UAE law.
- Place fraudulent or speculative orders, or order for commercial resale without our written agreement.
- Copy, scrape, mirror or republish any part of the site or its images.
- Attempt to interfere with, probe or overload the site or its security.
- Post content that is unlawful, offensive, misleading, or infringes anyone’s rights.
11. Intellectual property
The ISHAARA name, logo, product photography, copy, design and code on this site belong to us or our licensors and are protected by law. You may view and share pages for your own personal, non-commercial use. Any other use — including commercial use, reproduction or the creation of derivative works — needs our written permission first.
12. Content you send us
If you send us reviews, photographs, videos (including unboxing videos submitted with a claim) or other content, you keep ownership of it and grant us a non-exclusive, royalty-free licence to use it to handle your claim and, where the content is clearly promotional in nature, to display it on our site and channels. You confirm the content is yours to share and does not infringe anyone’s rights.
13. Privacy
We collect and use your personal data as set out in our Privacy Policy. We do not sell your personal data.
14. Third-party links and services
The site links to and relies on third parties — payment gateways, couriers, WhatsApp and social platforms. We are not responsible for their content, terms or availability, and your use of them is governed by their own terms.
15. Liability
Nothing in these terms limits liability that cannot be limited under UAE law, including liability for death or personal injury caused by our negligence, or for fraud. Subject to that, our total liability in connection with any order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss, loss of profit, or loss of opportunity.
The site is provided on an “as is” and “as available” basis. We do not guarantee that it will be uninterrupted or error-free.
16. Events outside our control
We are not liable for a delay or failure to perform caused by something outside our reasonable control, including courier disruption, customs, strikes, fire, flood, epidemic, war, government action, or failure of public networks or utilities.
17. Governing law
These terms and any dispute arising from them are governed by the laws of the United Arab Emirates as applied in the Emirate of Ajman, and the courts of Ajman have exclusive jurisdiction.
18. Severability and waiver
If any provision of these terms is found unenforceable, the rest continues in force. If we do not enforce a right straight away, that is not a waiver of it.
